Terms and Conditions

These Terms and Conditions govern access to and use of the CMN Realty Group website, publications, research library, interactive tools, forms, newsletters, downloads, and other digital content made available through CMN Realty Group.
1. Acceptance of These Terms
By accessing or using this website, you agree to these Terms, the Legal Disclaimer, and the Privacy Policy. If you do not agree, do not use the website. Separate terms may apply to a particular service, transaction, tool, event, download, subscription, or engagement and will control that specific activity to the extent of any direct conflict.
2. CMN Realty Group and Licensed Real Estate Activity
CMN Realty Group is a housing intelligence, property research, education, and advisory brand. Charles M. Nolan Jr., CA DRE #02223634, is a California real estate licensee affiliated with First Team Real Estate. Activities that require a California real estate license are conducted through First Team Real Estate and are subject to broker supervision, applicable California Department of Real Estate requirements, required disclosures, and transaction specific agreements.
California law requires specified licensee and responsible broker identification on qualifying real estate solicitation materials. See Business and Professions Code § 10140.6 and the DRE Real Estate Advertising Guidelines.
3. Relationship to First Team Real Estate
First Team Real Estate is the brokerage through which Charles M. Nolan Jr. conducts licensed real estate activity. CMN's research website is not the same website as firstteam.com. If you separately access First Team systems or services, the terms and privacy notices First Team presents may independently apply. See First Team's Terms of Use, Privacy Policy, and California Privacy Notice.
Nothing in these Terms should be read as altering First Team brokerage policies, broker supervision, transaction records, commission arrangements, or statutory duties applicable to licensed real estate activity.
4. No Agency or Professional Relationship From General Website Use Alone
General use of the website, including reading research, using a public search or calculator, subscribing to updates, downloading a publication, or making a preliminary inquiry, does not by itself establish a real estate agency relationship, fiduciary relationship, legal representation, tax advisory relationship, financial advisory relationship, lender borrower relationship, appraisal engagement, or public agency relationship. Whether an actual agency or professional relationship exists is determined by applicable law, agreements, required disclosures, and the facts of the interaction.
Where a real estate agency relationship is established, applicable statutory and fiduciary duties remain in force. See Civil Code § 2079.24.
5. Research, Publications, and Decision Support
CMN publications are designed to translate housing, economic, planning, property, demographic, public sector, and market information into clearer decision support. They are not a substitute for individualized legal, tax, financial, lending, engineering, appraisal, environmental, architectural, title, insurance, or other professional advice. Data may later be revised and market conditions may change after publication.
You agree not to treat a general publication as a promise of a particular transaction outcome, investment return, property value, loan approval, development approval, contract award, procurement result, or government decision.
6. User Responsibility and Independent Verification
You are responsible for evaluating whether information is current and appropriate for your particular circumstances. Material property, financial, legal, development, tax, financing, planning, insurance, title, school, HOA, permit, zoning, and public program information should be independently verified before reliance. If you are represented in a transaction, use the formal transaction process and qualified professionals to resolve transaction specific questions.
7. Artificial Intelligence Assisted Content
CMN may use AI assisted tools in research, drafting, data organization, calculations, quality review, chart production, and editorial workflows. AI is not an independent authority and can generate inaccurate or incomplete information. CMN intends to review published factual claims against source material. In licensed real estate activity, human professional judgment and required broker supervision remain applicable.
The California Department of Real Estate has emphasized that AI use does not transfer legal responsibility away from licensees or brokers. See the DRE AI in California Real Estate advisory.
8. Property Images and Visual Content
Editorial images may be illustrative and may not depict a specific property or factual condition unless identified. For actual property sale advertising, certain digitally altered images are subject to California disclosure and original image requirements. See Business and Professions Code § 10140.8.
9. Permitted Use of CMN Content
You may view, print, save, and share links to publicly available CMN content for personal, educational, internal business, or ordinary reference purposes, provided attribution and source context are preserved. You may not falsely imply authorship, endorsement, partnership, or sponsorship by CMN.
Without written permission, you may not reproduce substantial portions of CMN proprietary publications for commercial resale, remove attribution, create a confusingly similar branded publication, systematically scrape the site, circumvent access controls, interfere with site operation, or use substantial proprietary CMN content to train or improve a commercial model or competing content product where such use is not otherwise permitted by law.
10. User Submissions and Communications
When you submit a form, message, correction, research question, property inquiry, or other content, you represent that the information you provide is accurate to the best of your knowledge and that you have authority to provide it. Do not submit confidential transaction information, government restricted information, passwords, financial account credentials, medical records, Social Security numbers, or other highly sensitive information through general website forms unless a secure process specifically requests it.
Submitting a question does not obligate CMN to accept an engagement, provide representation, publish a response, or perform research. A custom engagement is formed only when the parties establish the required scope or agreement.
11. Email, Newsletter, and Marketing Communications
If you subscribe to CMN updates, CMN may send research, publication notices, market intelligence, service information, or other communications consistent with your request and applicable law. Marketing email is subject to federal requirements including accurate sender information, nondeceptive subjects, a valid postal address, and a functioning opt out process. See the FTC CAN SPAM compliance guide. You may unsubscribe from nonessential marketing communications using the method provided in the communication.
Consent to receive marketing is not a condition of purchasing real estate services unless expressly permitted by law. If a communication is sent through a separate First Team system, the consent and opt out terms presented by that system may also apply.
12. Third Party Sites, Property Search, Embeds, and Data Providers
The website may contain links to or embeds from government sources, property search providers, MLS data, builders, chart platforms, mapping tools, social networks, analytics providers, newsletter services, CRM services, and other third parties. CMN does not control those services and does not guarantee their availability, accuracy, privacy practices, accessibility, or security. Your use of a third party service may be governed by that provider's own terms and policies.
13. Fair Housing and Lawful Use
You may not use the site or CMN services to request, encourage, facilitate, or implement unlawful housing discrimination, steering, harassment, retaliation, or exclusion. California prohibits discriminatory housing conduct and discriminatory housing advertising. See Government Code § 12955. Federal law also prohibits specified discriminatory housing practices. See 42 U.S.C. § 3604.
14. No Guaranteed Outcomes
CMN does not guarantee property appreciation, investment performance, rent growth, financing approval, appraisal outcomes, permit or entitlement approval, builder delivery dates, incentive availability, government grants, procurement awards, contracting opportunities, sale timing, transaction closing, or any other future outcome.
15. Website Availability and Security
CMN may modify, suspend, remove, correct, or discontinue website content or features without notice. While reasonable efforts may be used to maintain the site, uninterrupted or error free operation is not guaranteed. Users must not attempt to introduce malicious code, gain unauthorized access, overload the site, bypass security controls, or interfere with another user's access.
16. Disclaimer of Warranties
To the fullest extent permitted by applicable law, general website content is provided on an as available basis without a warranty that every item is complete, current, error free, or suitable for a particular purpose. Nothing in these Terms disclaims warranties or duties that cannot legally be disclaimed.
17. Limitation of Liability
To the fullest extent permitted by applicable law, CMN will not be liable for indirect, incidental, special, exemplary, or consequential losses arising solely from a user's reliance on general website content, third party services, or unavailable website functionality. This limitation does not apply where prohibited by law and does not limit nonwaivable statutory duties, transaction disclosure duties, fiduciary duties, fair housing obligations, privacy obligations, or liability that cannot legally be limited.
18. Responsibility for Misuse and Indemnity
To the fullest extent permitted by law, a user who unlawfully misuses the site, infringes CMN intellectual property, introduces malicious software, violates another person's rights, or uses CMN content to facilitate unlawful conduct is responsible for losses directly resulting from that misuse. Any indemnity obligation under these Terms is limited to the extent enforceable under applicable law.
19. Governing Law and Venue
Except where applicable law requires otherwise, these website Terms are governed by California law. Any dispute concerning only these website Terms should be brought in a court of competent jurisdiction in Orange County, California. First Team's public Terms of Use likewise use California law and Orange County venue for its own website. See First Team Terms of Use. This paragraph does not change any venue, arbitration, dispute, or forum provision in a separately signed agreement.
20. Severability, No Waiver, and Entire Website Agreement
If a provision of these Terms is found unenforceable, it will be limited or severed to the minimum extent necessary without invalidating the remaining provisions. Failure to enforce a provision on one occasion does not waive future enforcement. These Terms, together with the Privacy Policy and Legal Disclaimer, form the general agreement governing use of this website, but do not supersede separate signed agreements governing real estate representation, consulting, research engagements, or other services.
21. Updates to These Terms
CMN may update these Terms as the website, services, technology, brokerage requirements, or law changes. The effective date above will be revised when a material update is posted. Continued use after an update means the updated Terms apply to subsequent use, subject to applicable law.

By checking an optional SMS consent box and submitting a mobile number, the visitor expressly agrees to receive calls and text messages from CMN Realty Group about the submitted inquiry and related real estate or housing intelligence services. Messages may be sent using automated technology. Consent is not required to submit a form or purchase goods or services.
Message frequency varies. Message and data rates may apply. Reply STOP to unsubscribe or HELP for assistance. Assistance is also available at Contact@cmnrealtygroup.com or 949 379 2022. Carriers are not liable for delayed or undelivered messages.
CMN will use the mobile number and consent record in accordance with the Privacy Policy. A person who opts out will not receive additional marketing text messages unless that person later provides new affirmative consent. CMN may modify or discontinue the messaging program as permitted by law.
