This Disclaimer applies to CMN Realty Group website pages, housing intelligence publications, research reports, market briefs, dashboards, charts, interactive visualizations, newsletters, social content, property and new construction content, downloads, public sector materials, and other information made available by CMN Realty Group.
1. Identity, Licensure, and First Team Real Estate
CMN Realty Group is a housing intelligence, property research, education, and advisory brand. Charles M. Nolan Jr., CA DRE #02223634, is a California real estate licensee affiliated with First Team Real Estate. Activities that require a California real estate license are conducted through First Team Real Estate and are subject to applicable California Department of Real Estate requirements, broker supervision, transaction forms, agency disclosures, and brokerage policies.
Nothing on this website should be interpreted as representing CMN Realty Group as a separately licensed real estate brokerage. California law requires specified licensee and responsible broker identification on qualifying real estate advertising and first point of contact solicitation materials. See California Business and Professions Code § 10140.6 and the California DRE Real Estate Advertising Guidelines, RE 27.
First Team Real Estate maintains separate website terms and privacy notices. When a visitor separately uses a First Team website, brokerage platform, or other First Team service, the terms and privacy notices presented by First Team may apply to that separate service. 2. General Information, Not Legal, Tax, Financial, Lending, Engineering, Planning, or Appraisal Advice
Unless CMN expressly enters into a written engagement defining a specific scope, website content and publications are general information, research, education, and decision support. They are not legal advice, tax advice, investment advice, securities advice, accounting advice, mortgage or lending advice, engineering advice, architectural advice, environmental advice, land survey advice, planning or zoning legal advice, or an appraisal. Readers should consult appropriately licensed or qualified professionals for decisions requiring those disciplines.
Market estimates, comparative market discussions, automated values, affordability calculations, pricing scenarios, and similar material are not certified appraisals and should not be treated as a substitute for an appraisal when one is required.
3. Website Use Does Not by Itself Create an Agency or Fiduciary Relationship
Viewing a page, reading a publication, downloading a report, subscribing to a newsletter, following a social account, or making a preliminary inquiry does not by itself establish a real estate agency relationship, fiduciary relationship, attorney client relationship, financial advisory relationship, public agency relationship, or other professional engagement. Whether an actual agency relationship exists is determined by applicable law, written agreements, required disclosures, and the facts of the parties' interaction.
California law requires agency disclosures in covered real property transactions and describes the duties associated with seller, buyer, and dual agency. See Civil Code § 2079.14 and Civil Code § 2079.16.
4. Existing Clients and Nonwaivable Duties Are Preserved
If Charles M. Nolan Jr. and First Team Real Estate are actually representing a buyer, seller, or other principal, this website Disclaimer does not reduce the duties owed in that relationship. California law expressly provides that agency statutes do not diminish duties of disclosure or relieve agents and associate licensees from liability for conduct or breach of fiduciary duty. See Civil Code § 2079.24. California also defines a professional standard of care for licensees in covered residential transactions. See Civil Code § 2079.2.
A signed listing agreement, buyer representation agreement, purchase agreement, advisory scope, consulting agreement, confidentiality agreement, or other written contract may impose obligations beyond this general website Disclaimer. The applicable signed agreement controls the specific engagement to the extent permitted by law.
5. Truthful Advertising and Real Estate Communications
CMN intends its marketing and licensed real estate communications to be truthful, supportable, and not misleading. California law authorizes discipline for substantial misrepresentation, false promises, fraud, dishonest dealing, and other misconduct by a real estate licensee. See Business and Professions Code § 10176. Federal truth in advertising principles also apply to online marketing. See the Federal Trade Commission Online Advertising and Marketing guidance.
No disclaimer is intended to excuse an inaccurate or deceptive statement. If a publication or marketing item contains an error, CMN may correct, clarify, update, or withdraw it.
6. Research, Data, Sources, and Publication Vintage
Housing and economic data can be revised after publication. Government series, MLS information, market reports, public records, builder information, planning documents, demographic estimates, interest rates, property records, and third party datasets may contain delays, omissions, revisions, methodological limitations, or errors. CMN publications are intended to identify material sources and, where practical, the applicable reporting period or data vintage.
A publication should be read as of its stated publication or update date. A source link does not mean CMN controls that source or guarantees that it will remain available. Readers making a material financial, legal, property, lending, development, or procurement decision should verify current facts directly with the authoritative source and appropriate professionals.
Charts and visualizations may summarize, normalize, calculate, compare, or transform source data for clarity. The methodology notes, labels, units, source dates, and source register control over any informal visual impression.
7. Artificial Intelligence and Human Review
CMN may use artificial intelligence assisted tools for research discovery, transcription, drafting, summarization, calculations, data organization, visualization production, quality control, and editorial workflows. AI output is not an independent authority and may contain errors or unsupported statements. Published factual claims are intended to be reviewed against source material before reliance.
The California Department of Real Estate has advised that use of AI does not shift legal responsibility away from the licensee or broker, that real estate advertising must remain truthful and accurate, and that licensees should independently verify factual claims. See the DRE advisory on AI in California real estate. AI is therefore treated as an assistive tool, not as a substitute for professional judgment or required review.
8. Images, Illustrations, and Digitally Altered Property Marketing
Editorial hero images, conceptual visuals, stock photography, diagrams, and other illustrative imagery may be used to communicate a topic and may not depict a specific property, transaction, agency, client, neighborhood, or factual condition unless expressly identified.
For advertising or promotional material involving the sale of actual real property, California law effective January 1, 2026 imposes disclosure and original image requirements when a broker, salesperson, or person acting on their behalf uses certain digitally altered images. See Business and Professions Code § 10140.8. CMN's general editorial use of illustrative imagery is not intended to represent an altered condition of a listed property.
9. Property Listings, MLS, Public Records, and Third Party Property Data
Property listing data, open house information, maps, parcel information, school references, estimated values, tax data, lot characteristics, community descriptions, and similar property information may originate with MLS systems, listing brokers, public agencies, data vendors, builders, portals, or other third parties. Such information may be changed, withdrawn, delayed, incomplete, or unverified. Property availability and terms are subject to change without notice.
Consumers should independently verify information that is material to their decision, including square footage, lot size, boundaries, permits, zoning, schools, taxes, assessments, HOA terms, insurance availability, utilities, views, condition, and property eligibility. First Team's own public terms similarly caution that listing data may come from multiple sources and should be independently reviewed; see First Team Terms of Use.
10. Financing, Mortgage Rates, Affordability, and Payment Scenarios
Mortgage rates, payment examples, incentive scenarios, affordability estimates, tax assumptions, insurance assumptions, HOA estimates, closing cost examples, and builder financing illustrations are educational scenarios unless expressly provided by an appropriately licensed lender in a specific transaction. They are not loan commitments, credit decisions, rate locks, or guarantees of qualification. Actual financing depends on lender underwriting, borrower qualifications, property eligibility, market conditions, program rules, and terms in effect at the relevant time.
11. New Construction, Builder Incentives, and Registration Rules
Builder inventory, incentives, design options, lot premiums, financing programs, release schedules, community plans, delivery dates, taxes, fees, HOA terms, and product specifications can change at any time. Builder representatives generally represent the builder, not the buyer. A buyer who wants independent representation should establish the required representation and builder registration relationship before or at the first builder interaction when required by the builder's policies.
CMN is not the builder and does not control construction quality, completion dates, warranties, incentive availability, lender underwriting, or builder policies. Builder materials should be verified directly with the builder and incorporated into the governing purchase documents before reliance.
12. Investment, Market Forecasts, and No Guaranteed Outcomes
Past market performance does not guarantee future appreciation, rent growth, resale value, occupancy, investment returns, development feasibility, or liquidity. Forecasts and scenarios are inherently uncertain. CMN does not guarantee investment performance, tax treatment, financing approval, appraisal results, property appreciation, resale timing, government approvals, grant awards, public contracts, procurement awards, or any specific financial result.
13. Planning, Zoning, Development, Land Use, and Public Sector Research
Planning, zoning, entitlement, permitting, development pipeline, infrastructure, public finance, housing program, procurement, grant, and policy information may be based on public records and agency materials that change over time. CMN does not issue permits, legal opinions, engineering conclusions, planning approvals, environmental clearances, procurement determinations, or government decisions. Users should verify current requirements directly with the responsible public agency and qualified professionals.
SAM.gov registration, California eProcure registration, or California Small Business certification indicates registration or certification status only. It does not constitute endorsement by a government agency and does not guarantee eligibility for, award of, or payment under any contract, grant, teaming arrangement, or procurement opportunity.
14. Fair Housing, Equal Opportunity, and Anti Steering
CMN supports equal housing opportunity. Content, search tools, market comparisons, neighborhood information, demographic analysis, and AI assisted workflows are not intended to steer, exclude, discourage, or express a housing preference based on a protected characteristic. California law prohibits discriminatory housing practices and discriminatory housing advertising across a broad set of protected characteristics. See California Government Code § 12955. Federal law also prohibits specified discriminatory housing practices and advertising. See 42 U.S.C. § 3604.
Market and demographic research may describe aggregate conditions for legitimate research purposes. Such analysis is not a recommendation concerning the protected characteristics of residents or prospective residents.
15. Referrals, Affiliations, Endorsements, and Material Connections
CMN may reference brokerage relationships, professional affiliations, builders, lenders, vendors, data providers, technology platforms, associations, public agencies, research organizations, and other third parties. A reference does not by itself mean endorsement, sponsorship, agency, partnership, or a paid relationship. Where CMN receives compensation, a referral fee, a benefit, free access, or another material connection that is required to be disclosed, CMN intends to provide an appropriate disclosure. 16. Third Party Websites, Tools, Embeds, and Services
The site may link to or embed government websites, MLS or property search tools, chart platforms, analytics services, newsletter systems, customer relationship systems, builder or new construction resources, social platforms, mapping tools, and other third party services. Those services operate under their own terms, availability, accessibility, privacy practices, and security controls. CMN does not control and is not responsible for third party content or service interruptions.
17. Intellectual Property and Source Attribution
CMN authored articles, research summaries, original calculations, graphics, page copy, branding, and original visualizations are protected by applicable intellectual property law unless otherwise stated. Government and third party source materials remain subject to the rights and terms of their respective owners. Citation of a source does not transfer ownership of the source to CMN.
Reasonable sharing of CMN public links with attribution is permitted. Republishing, scraping, reproducing, selling, training a commercial model on substantial portions of CMN proprietary content, removing attribution, or representing CMN work as another party's work is prohibited except with permission or where applicable law provides otherwise.
18. No Warranties and Limits Permitted by Law
To the fullest extent permitted by applicable law, CMN provides general website and publication content on an as available basis and does not warrant that every item will be error free, complete, continuously available, or suitable for a particular decision. Users remain responsible for obtaining current facts and professional advice appropriate to their circumstances.
Nothing in this Disclaimer excludes or limits liability, disclosure obligations, fiduciary duties, statutory duties, fair housing duties, privacy obligations, or other responsibilities to the extent they cannot lawfully be excluded or limited.
